Plaintiffs’ newborn daughter suffered permanent brain damage because of negligent nursing care when a nurse failed to report multiple signs of sepsis to a physician. A Colorado jury, after three weeks of testimony, awarded the family over twenty-seven million dollars in damages. Defendants appealed the case all the way to the Colorado Supreme Court which upheld Plaintiffs’ verdict and made new case law within the State of Colorado regarding the mechanisms and application of Colorado’s Medical Malpractice Cap. Together with interest, the total award equaled over forty million dollars, the largest medical malpractice award in Colorado history.
