PBC Files Class Action Case Against DuPont Over Imprelis Herbicide

PBC has filed a class action case against DuPont, the maker of the Imprelis herbicide which has been reported responsible for serious environmental damage and death of trees particularly evergreens such as Norway Spruce, Eastern White Pine and other shallow root system trees such as Deodora Cedar, Balsam Fir, Willow Trees, Conifer Trees and Poplar Trees.

DuPont introduced the Imprelis herbicide in October 2010.  Imprelis is used for killing broadleaf weeds like dandelion and clover and is sold to lawn care professionals only.  DuPont claimed the herbicide was safer for the environment than 2,4-D Dichlorophenoxyacetic acid and other older herbicides; they marketed Imprelis as a low environmental impact herbicide.  Landscapers who used Imprelis began reporting dead and damaged trees.  Wilting and browning leaves at the end of branches is the most obvious symptom of Imprelis tree damage and curling and twisting of new growth has also been observed.

PBC’s lawsuit is brought on behalf of individuals and entities whose property was exposed to Imprelis directly or indirectly, in particular those who own property on which Imprelis was applied and trees and other vegetation whose roots extend under property on which Imprelis was applied or property onto which Imprelis migrated.

CertainTeed Siding: Shrinking, Cracking, Warping Problems

Property owners  have complained that CertainTeed WeatherBoards fiber cement exterior siding products have caused a number of problems including:  shrinking, cracking and warping as well as large gaps between the siding boards.  Fiber cement siding is used to cover the exterior wall of a house and is an alternative to vinyl or wood siding.  It has been known to be durable and resistant to fire, termites and rot.  Other complaints against CertainTeed fiber cement siding have been that it has a tendency to freeze during winter,  poor paint adhesion and significant moisture absorption.

A warranty is offered with these products, but those that have experienced problems with CertainTeed fiber cement complain that the manufacturer did not abide by the terms of its contracts.

Uponor Pex Defective Plumbing Fixtures

This is litigation against Uponor, Inc. and a related company RTI, for defective Pex plumbing systems.  Uponor’s fittings are identified by a P Pex or MB Pex stamped on their side.  Homeowners claim that Uponor’s brass fittings were incorrectly designed and manufactured.  As a result, the fittings fail prematurely – sometimes only months after installation.

Uponor has admitted that these plumbing fittings were “defective,” “unreasonably dangerous” and “not merchantable.”  Substantial water damage may occur when the fittings fail.  Uponor has stopped selling this style of brass pex fitting.  Uponor’s plastic fittings and fittings made by other manufacturers are not included in this litigation.

Propecia/Proscar (Finasteride) Can Cause Persistent Sexual Dysfunction And May Be Linked To Certain Birth Defects

A Journal of Sexual Medicine study revealed that Finasteride, used to treat hair loss and marketed as Propecia, can cause persistent and possible irreversible sexual dysfunction.  Low sexual desire, erectile dysfunction and problems with orgasms have been reported.  Infertility, reduced ejaculate in men and a link to certain birth defects have also been claimed.  Many men turned to medical professionals for help and have been told that it was psychological in nature because the literature does not show a risk of persistent sexual dysfunction. 

Finasteride is also marketed as Proscar in a higher dosage for treatment of benign prostatic hypertrophy or enlargement of the prostate gland.

Zocor (Simvastatin) 80 mg Daily Dosage Causes Increased Risk Of Myopathy (Rhabdomyolysis)

Taking simvastatin 80mg daily causes an increased risk of myopathy (rhabdomyolysis).  The FDA notified healthcare professionals that it is recommending limiting the use of the highest approved dose of the cholesterol-lowering medication.  Patients have an increased risk of muscle damage caused by taking simvastatin 80mg daily compared to patients taking lower doses of this drug or other drugs of the same class.  The risk appears to be higher during the first year of treatment.  Rhabdomyolysis is the most serious form of myopathy, it can cause kidney damage and failure which can lead to death.  Required changes to the simvastatin label by the FDA add new contraindications and dose limitations for using the drug with certain medicines.  Simvastatin 80 mg should not be started in new patients, including patients already taking lower doses.  Simvastatin is sold under the brand-name Zocor, as a single-ingredient generic product, and sold in combination with ezetimibe as Vytorin and in combination with niacin as Simcor.

Fosamax Femur Fracture

Long-term use of the drug Fosamax, a Bisphosphonate, may increase the risk of low-energy bone fractures, involving the thigh bone or femur.  A study published in The Journal of American Medical Association on February 23, 2011, concludes that prolonged Bisphosphonate use leads to devastating femur fractures.  Normally a large amount of force is required to break this bone.  Ironically, Fosamax is designed to prevent bone loss and reduce the risk of broken bones.

Fosamax is prescribed to treat osteoporosis and reduce the risk of hip fractures and long bone fractures.  However, side effects of Fosamax may weaken the ability of the bone to repair itself from microdamage, increasing the risk of a bone fracture over time.

SSRIs

SSRIs, or Selective Serotonin Reuptake Inhibitors, are a class of drugs that act on the neurotransmitter serotonin to boost mood and treat a variety of other symptoms and conditions.  These drugs include:

  • Zoloft (Sertraline)
  • Lexapro (Escitalopram)
  • Prozac and Sarafem (Fluoxetine)
  • Celexa (Citalopram)
  • Paxil (Paroxetine)
  • Effexor (Venlafaxine)
  • Pristiq (Desvenlafaxine)

Birth Defects

Numerous studies, described in detail under SSRI birth defects, have found that SSRI use during pregnancy greatly increases the risk of myriad birth defects.  Here are just a few findings from the many studies conducted on SSRI and birth defects:

  • PPHN is six times more common in babies whose mothers use SSRIs during pregnancy
  • Neonatal abstinence syndrome, the term for newborn drug addiction, occurs in approximately 30 percent of infants whose mothers use SSRIs during pregnancy
  • Zoloft appears to more than triple the risk of life-threatening heart defects.  Use of more than one SSRI increases the risk of this heart defect five-fold.
  • Pregnant women taking SSRIs were 68% more likely to suffer miscarriage
  • Maternal use of SSRIs later in pregnancy cause delays in infant’s motor development.

Interior/Exterior Chinese Drywall Class Settlement

At least 1,200 to 1,500 property owners are eligible for portions of the $8 million settlement agreed to by a Chinese drywall supplier’s insurer to court claims against the company over damage to homes from the corrosive product.

A court filing Tuesday asks U.S. District Judge Eldon Fallon in New Orleans to approve the deal between plaintiffs’ attorneys, Interior/Exterior Building Supply and two of its three insurers.

Just a share of thousands of claims from homeowners claiming the drywall caused problems ranging from foul odors to corrosion would be covered by the settlement.  Interior/Exterior was already participating in a pilot program to repair 300 homes in several states.
