			<content:encoded><![CDATA[<p><span style="color: #000000;">Pendley, Baudin &amp; Coffin Law Firm, LLP is investigating claims of <a title="Insurance Bad Faith" href="http://pbclawfirm.com/areas-of-practice/insurance-bad-faith/">Household Life Insurance Company improperly denying credit disability insurance benefits.</a>  Household Life Insurance Company is a subsidiary of HSBC.  Household Life Insurance Company primarily sells its credit disability insurance through other subsidiaries of HSBC, including Beneficial Mortgage Company and Mortgage One Corporation d/b/a HFC Mortgage Corporation.</span></p>
<p><span style="color: #000000; font-family: Helvetica; font-size: x-small;"> </span><span style="color: #000000;">The credit disability insurance is routinely sold during a mortgage closing.  The credit disability insurance appears to pay the policyholder’s mortgage each month the policyholder is disabled but Household Life Insurance Company stops the mortgage payments after a twenty-four (24) month period. Household Life Insurance Company argues that it can stop the mortgage payments because the credit disability insurance policy contains a “Critical Period” which limits the number of months that Household Life Insurance Company must pay benefits for one period of disability.  However, Household Life Insurance Company does not disclose the Critical Period at the time the credit disability insurance is purchased.  Some policyholders are not told about the Critical Period in their credit disability insurance policy until after they are disabled and Household Life Insurance Company is about to improperly cut off their benefits. Even if the policyholders are provided a copy of a certificate of insurance after the mortgage closing, the certificate of insurance is ambiguous and confusing, and does not adequately disclose the Critical Period.</span></p>
<p><span style="color: #000000; font-family: Helvetica; font-size: x-small;"> </span><span style="color: #000000;">Insurers have an affirmative duty to fairly deal with their insured’s in good faith. Household Life Insurance Company’s failure to properly and adequately pay its insured’s under the credit disability insurance may result in statutory penalties, including bad-faith damages and attorney&#8217;s fees.  In instances where an insured is able to prove bad faith conduct against their insurer, the penalties and damages may be substantial. Several lawsuits have been filed concerning the enforcement of the “Critical Period” in Household Life Insurance Company’s credit disability policies.</span></p>

<p style="text-align: center;"><strong>Pregnant Mother Ingests Anti-Depressant Drug; Infant Dies</strong></p>
<p>PHILADELPHIA – Feb. 9, 2012 – Today, in the Philadelphia Court of Common Pleas, six attorneys from across the country filed what is believed to be the first birth defect case against EFFEXOR®, a popular and common drug used in the treatment of depression. Alleging the death of an Ohio infant was directly related to her mother’s ingestion of EFFEXOR®, the young girl’s parents are represented by Thomas Anapol and Gregory Spizer of Anapol Schwartz; <strong>Christopher Coffin and Nicholas Rockforte of Pendley, Baudin &amp; Coffin, L.L.P.</strong>; David Landever of Weisman, Kennedy &amp; Berris, LPA; and Tim Becker of Johnson Becker, PLLC.</p>
<p>The case is believed to be the first that declares a link between birth defects and use of the prescription drug, manufactured by Wyeth Pharmaceuticals and Pfizer, Inc. Also listed on the complaint is Wolters Kluwer Health/United States, Inc. as the labelers and distributors of information about the drug.</p>
<p>“The information that patients – especially women who are pregnant – receive about the medication that is prescribed to them is crucial,” said Thomas Anapol, a Philadelphia-based attorney heavily focused in pharmaceutical and catastrophic injury civil litigation. “This SNRI (serotonin and norepinephrine reuptake inhibitor) drug was approved by the FDA in 1993, but the parties involved neglected to disclose the birth defect risks to physicians treating women of child-bearing age.”</p>
<p>In <em>Boyer &amp; Boyer v. Wyeth Pharmaceuticals, et al.,</em> plaintiffs Glenn and Lauren Boyer were overjoyed to learn that they would be having a baby girl, who they named Adelaide. However, shortly after taking her first breath on Feb. 11, 2010, it was discovered that Adelaide suffered lethal cardiac anomalies, including severe left hypoplastic heart, a malformed aorta, no aortic value, a malformed mitral valve and other related conditions. The Boyers allege that the anomalies were caused by Mrs. Boyer’s use of EFFEXOR®.</p>
<p>The filed complaint contains 16 individual counts against the three defendants. In addition to failure to warn and negligence claims, the suit alleges that fraud and misrepresentation led to Adelaide’s death.</p>
<p>“It is likely that the defendants had evidence to the contrary of what was disseminated for public information,” according to registered nurse and attorney <strong>Christopher Coffin</strong> of New Orleans, La., who specializes in pharmaceutical litigation throughout the country. “To minimize and understate the risks was to place Adelaide and her family in an experiment they would never have consented to.”</p>

			<content:encoded><![CDATA[<p><span style="color: #000000;">Medtronic, manufacturer of Infuse, failed to disclose serious and potentially life-threatening side effects.<span style="font-family: Times New Roman;">  </span></span><span style="color: #000000;">Infuse is often used in spinal fusion operations in which spinal vertebrae are fused together to reduce back pain; it is a bioengineered material that spurs bone growth.  It as reported that in none of the 13 trials funded by Medtronic were any adverse events disclosed.  It has been reported that up to 50 percent of patients  who received Infuse suffered side effects including infection, pain, cyst formation and cancer.</span></p>
<p><span style="color: #000000; font-family: Times New Roman;"> </span><span style="color: #000000;">The U.S. Food and Drug Administration approved Infuse for only anterior approach lumbar fusion surgery.<span style="font-family: Times New Roman;">  </span></span><span style="color: #000000;">Many patients have received Infuse in off-label uses in either the lumbar or cervical spine.  The FDA has not authorized Infuse in either lateral or posterior approach lumbar fusion surgeries or for use in the cervical spine.</span></p>
<p><span style="color: #000000; font-family: Times New Roman;"> </span><span style="color: #000000;">The patient must be informed of off-label or experimental use of a drug or medical devise by a physician prior to surgery and full disclosure of the risk.<span style="font-family: Times New Roman;">  </span></span><span style="color: #000000;">Many patients who received off-label use of Infuse in their spine were not informed.  Specific side effects reported from the off-label use of Infuse:</span></p>
<ul>
<li><span style="color: #000000;">Ectopic bone growth or uncontrolled bone growth in the spinal canal</span></li>
<li><span style="color: #000000;">Ongoing or chronic radiating pain in the legs or arms called radiculopathy or radiculitis</span></li>
<li><span style="color: #000000;">Sterility, retrograde ejaculation, or other urogenital injuries in male patients</span></li>
<li><span style="color: #000000;">In cervical spine surgeries: acute neck swelling several days after surgery resulting in death or permanent injury</span></li>
<li><span style="color: #000000;">Nerve injuries causing chronic pain</span></li>

			<content:encoded><![CDATA[<p>Rice and crawfish farmers adversely affected by oil barge collision with the gates of Leland Bowman Lock on September 30, 2011.  The lock is located on Freshwater Bayou in Vermillion Parish, Louisiana.  As a result of the collision, the gates were damaged and the U.S. Army Corps of Engineers has removed the gates and sent them to Morgan City, Louisiana to be repaired.  The original purpose of the Leland Bowman Lock structure was to keep saltwater from flowing from Vermillion Bay into the Gulf Intracoastal Waterway.  As a result of the flow of saltwater, the salinity levels in the Intracoastal have risen to historically high levels.  This adversely affects  the rice and crawfish farmers who traditionally flood their fields using water from the Intracoastal Waterway.  Pendley, Baudin &amp; Coffin, L.L.P. has filed a class action lawsuit in Vermillion Parish District Court against  Canal Barge Company, the owner operator of the towboat and barge which struck the lock gates, seeking damages for all rice and crawfish farmers who will suffer reduced production or the inability to harvest either rice or crawfish because of the high salt level in the Intracoastal water.  If you believe you may suffer economic loss as a result of the saltwater in the Intracoastal Waterway, please contact our office for additional information.</p>

			<content:encoded><![CDATA[<p>Knauf Plasterboard Tianjin Co. has agreed to pay hundreds of millions of dollars  to settle claims by thousands of Gulf Coast property owners.  These owners claim the product damaged their homes.</p>
<p>On Thursday, U.S. District Judge Eldon Fallon in New Orleans announced the settlement.  The settlement calls for Knauf to create an uncapped fund to pay for repairs for an estimated 4,500 homes in Florida, Louisiana, Mississippi and Alabama.  Judge Fallon must sign-off on the settlement before any money is distributed.  The estimated value of the settlement is between $800 million and $1 billion.</p>
