GAF Timberline Shingles Lawsuit: Shingles Crack Prematurely
Since the late 1990s, GAF Timberline Shingles have had an increase in the rate of shingle cracking, curling, warping and other deterioration. Property owners with GAF Timberline shingles should be warned that such cracking may cause leaks, cosmetic defects and other problems with roofs of their properties.
GAF Shingle Cracking Teams and Defective Materials
From 2001 – 2002, GAF fiberglass shingles cracking claims increased 43%, and was internally noted by GAF that the shingles made at one of its plants was the “fastest growing problem.” As a result of the increase in cracking claims, GAF formed “cracking teams” meant to investigate the cause of defective tendencies in their fiberglass shingles, like the Timberline series.
GAF concluded that the plants that had problems with raw materials causing premature cracking were located in Minneapolis, Minnesota; Baltimore, Maryland; Millis, Massachusetts; and Fontana, California. Additional investigation found that manufacturing plants in Mobile, Alabama and Dallas, Texas also had the same problems.
After finding the issue with the defective fiberglass shingles, GAF switched the raw materials used for laminated fiberglass shingles in hope of fixing the cracking defect. However, despite finding the cause for shingles cracking prematurely, GAF has not issued a recall of the products made of those raw materials. This leaves thousands of property owners with these defective shingles on their roofs.
Lawsuits Involving GAF Fiberglass Shingles
The premature cracking defect in GAF Shingles has caused GAF to previously be identified as defendants in lawsuits. One of these lawsuits was a putative class action titled Coleman, et al. v. GAF Building Materials Corporation, CV-96-0954 (Alabama Circuit Court, Mobile County). The Coleman lawsuit was in the end settled with GAF paying more than $13 million to resolve cracking claims. In this class action settlement, only shingles manufactured before December 31, 1997 are included.
Another class action lawsuit was recently filed for South Carolina residents with GAF shingles cracking after the Coleman settlement, and more lawsuits are expected.
